Since the 2004 tsunami reshaped India's approach to disasters, the institutional architecture has matured, but implementation still lags where it matters most.

Two Decades of the Disaster Management Act: What India Learned and What It Still Hasn't

The Indian Ocean tsunami of December 2004 killed more than ten thousand people along India's coastline, most of them in Tamil Nadu and the Andaman and Nicobar Islands, in an event that exposed a near-total absence of institutional capacity for disaster warning, response and coordination. The Disaster Management Act, passed the following year, created a structure previously missing from Indian governance: a National Disaster Management Authority chaired by the Prime Minister, State Disaster Management Authorities, District Disaster Management Authorities, and a National Disaster Response Force of dedicated, trained personnel equipped for search, rescue and immediate relief operations.

Two decades on, the record is genuinely mixed in instructive ways, strong where the system has been tested repeatedly against a familiar hazard, and weaker where the hazard is newer, more diffuse, or requires cooperation across agencies that the Act's architecture did not anticipate needing to coordinate as tightly.

Cyclone response: the clearest success story

India's improvement in cyclone preparedness over the past two decades is one of the more underappreciated public administration achievements of the period. The 1999 Odisha super cyclone killed close to ten thousand people, a toll that reflected almost no organised evacuation capacity at the time. By contrast, Cyclone Phailin in 2013, of comparable intensity, killed fewer than fifty people in Odisha because the state government, building on National Disaster Management Authority protocols and India Meteorological Department forecasting improvements, evacuated close to a million people in the days before landfall using a well-drilled system of cyclone shelters, early warning dissemination through local officials, and pre-positioned relief supplies. Subsequent cyclones, including Fani in 2019 and Amphan in 2020, have followed a broadly similar pattern of dramatically reduced mortality relative to comparable historical storms, even as economic damage from wind and flooding remains substantial.

This success rests on factors the Disaster Management Act's architecture enabled directly: a clear chain of command from national forecasting to state-level evacuation orders to district-level implementation, a trained National Disaster Response Force that states can call upon, and crucially, political consensus that cyclone evacuation is a a non-negotiable administrative duty rather than a discretionary response, likely reinforced by the vivid public memory of the 1999 disaster's toll.

Urban flooding: the system's clearest blind spot

The same institutional architecture has performed far less impressively against urban flooding, a hazard that has become dramatically more damaging as Indian cities have paved over natural drainage and encroached upon lakes, wetlands and floodplains. Chennai's 2015 floods, Mumbai's recurring monsoon inundations, and Bengaluru's 2022 flooding of even its wealthiest tech corridors share a common structural cause that disaster response protocols built around cyclone-style evacuation are not designed to address: the problem is not primarily about warning and evacuating people from a predictable, trackable storm system, but about decades of accumulated urban planning failure, unauthorised construction on stormwater drains, inadequate drainage capacity for rainfall intensities that climate change has made more common, and municipal governments that lack either the capital budget or the political will to prioritise drainage infrastructure over more visible projects.

The National Disaster Management Authority's own guidelines on urban flooding, issued as far back as 2010, identified most of these structural causes accurately, yet implementation sits with municipal corporations and urban development authorities whose planning failures created the vulnerability in the first place, and who face weak incentives and limited capacity to reverse decades of encroachment through politically difficult measures like clearing illegal construction on drainage channels or lakebeds. Disaster response protocols can evacuate people from a rising floodwater, but they cannot substitute for the stormwater master planning and drain desilting that would prevent the flooding from reaching evacuation-level severity in the first place.

The financing gap between response and prevention

India's disaster financing architecture, built around the National Disaster Response Fund and State Disaster Response Funds, is structured overwhelmingly around post-disaster relief and reconstruction rather than pre-disaster risk reduction investment. States receive funds to compensate for crop loss, rebuild damaged infrastructure and provide relief to affected families after a disaster strikes, but comparatively little dedicated financing exists for the mitigation investments, drainage infrastructure, resilient housing retrofits, early warning system maintenance, that would reduce the scale of damage in the first place. The Fifteenth Finance Commission's recommendations did increase allocation toward mitigation funds relative to earlier finance commission cycles, a positive shift, but the proportion remains small relative to response and relief spending, reflecting a broader pattern in Indian public finance where visible post-disaster relief carries clearer political reward than invisible, preventive infrastructure spending whose benefit is a disaster that never happens or happens less severely.

Local capacity remains the weakest link

District Disaster Management Authorities, the ground-level implementing bodies the Act envisioned as central to localised response, remain in practice thinly staffed and often subordinate in practice to the district collector's many other administrative responsibilities rather than functioning as dedicated, resourced units. Training, equipment and even basic hazard mapping vary enormously across India's districts, and the National Disaster Response Force, while highly capable, is a limited national resource that cannot be everywhere at once during simultaneous or geographically dispersed events, meaning ultimate response quality still depends heavily on state and district capacity that the Act's design assumed would be built up more uniformly than it has been.

A structure built for the last disaster, adapting slowly to the next

The counter-argument in the system's defence deserves acknowledgment: institutional capacity building is inherently incremental, and expecting a single legislative act to produce uniform excellence across the enormous diversity of Indian states and hazard types within two decades sets an unrealistic bar. Cyclone response improved through repeated, drilled practice against a hazard with clear historical precedent and lead time for forecasting. Urban flooding, heat waves and glacial lake outburst floods are comparatively newer or more complex hazards where the equivalent institutional muscle memory has not yet been built, and building it will take further disasters, further reviews, and further incremental reform, a genuinely difficult process to accelerate simply by legislative fiat.

That said, twenty years is long enough that the pattern is now clear enough to act on with more urgency than the current pace suggests. India does not need a new disaster management law; it needs the existing architecture's financing tilted more deliberately toward prevention over relief, district authorities genuinely resourced rather than nominally constituted, and urban flooding treated with the same institutional seriousness that transformed cyclone response from a mass casualty event into a manageable, if still damaging, annual occurrence.
