Tens of millions of cases are pending across Indian courts, and a large share have waited for years. Delay is not a neutral inconvenience — it functions as a penalty on the party with less money and time, and it makes undertrial detention a punishment before conviction for people who cannot afford bail. The causes are structural: judge-to-population ratios far below sanctioned strength, vacancies left unfilled, adjournment culture, procedural complexity, poor case-flow management, and appeals that restart questions already settled. Legal aid exists but is thinly staffed and poorly known. Police investigation quality, forensic capacity and witness protection all shape outcomes long before a judge is involved. Meanwhile the sheer opacity of court data, though improving, still makes it hard for the public to see where the bottlenecks actually sit — which court, which stage, which category of case.

Rights that cannot be enforced in reasonable time are not rights. Judicial delay affects a farmer's land dispute, a widow's inheritance, a small firm's unpaid invoice and an undertrial's liberty alike, and it quietly raises the cost of doing anything honestly in India. A functioning justice system is the precondition for contracts, for property, for personal safety, and for the constitutional promises the rest of public life depends on.
